How do I know if I qualify for medical leave?

Before we discuss the reasons a person may need medical leave, we need to determine whether your employer must comply with these laws. If your employer has had at least 50 employees for at least 20 weeks in the current or previous year, they must comply with FLMA/CFRA.

In addition, you are eligible if you have:

  • worked for the company at least a year
  • worked at least 1,250 hours the previous year
  • worked at a location with 50 employees within a 75-mile radius

If these conditions are met, you are eligible to take up to 12 weeks of unpaid leave.

You are eligible if you have a serious health condition that requires inpatient care or continuing treatment. This includes chronic conditions that occur intermittently such as IBS, asthma, and migraines.

You can also use medial leave for the birth of a child or the adoption of a child as well as for caregiving for a spouse, parent, or child with a serious medical condition.

When you return to work after medical leave

Your employer cannot retaliate against you for taking or requesting medical leave under FMLA/CFRA.

When you are ready to return to work after medical leave, whether you took a few days or the entire 12 weeks allowed under the law, your employer must return you to the same position you had or one that has similar pay, benefits, and job responsibilities as the one you had.
