What you need to know about medical leave in California

We want you to know that the federal Family and Medical Leave Act (FMLA) and the California Family Rights Act (CFRA) offers protection to employees who need to take medical leave. However, you need to know if your employer qualifies under the law.

California employers must comply with FMLA if they have at least:

  • 50 employees for at least 20 weeks in the current or previous year

For an employee to qualify for medical leave, they must:

  • Have worked for the employer at least a year
  • Have worked at least 1,250 hours the previous year
  • Have worked at a location with 50 employees within a 75-mile radius

What conditions allow for me to take medical leave?

There are various reasons that a person may need to take the allowed 12 weeks of medical leave time provided for under the law. All an employee has to do is notify their employer that they have a serious health condition that will require inpatient treatment or ongoing care. You can also take medical leave for intermittent chronic conditions such as migraines, asthma, IBS, etc. if your doctor certifies the condition.

Medical leave is also eligible for:

  • The birth or adoption of a child
  • Caregiving of a serious health condition of a spouse, child, or parent

Reinstatement when medical leave is over

Your employer cannot retaliate against you due to taking or requesting medical leave. Upon your return from medical leave, you must be returned to a job with similar pay and benefits and job responsibilities.
